申請H1B的時候, 一個雇主可以為同一個僱員上交多份申請嗎?

2013年H1B抽籤了,所以很多客人都在擔心2014年申請時,H1B是不是還會抽籤,如果抽不上怎麼辦?有些客人提出了這樣的問題:“既然抽籤之前,移民局都不會審理申請材料,那麼雇主可不可以遞交多份申請來增大抽籤抽到的機率呢?”


簡單的來說:不行。


移民局從2008年3月19日起,明文規定了禁止雇主為同一位僱員遞交多次申請。這樣的情況包括同一位雇主為同一個僱員申請同樣的職位,也包括了同一位雇主為同一個僱員申請不同的職位。如果移民局發現了這樣的情況,移民局會拒絕您的案子,已經通過的也會被撤回,同時多份申請的費用也不會被退回。

In 2013, there is a lottery for H1-B, so many clients are worried about whether there will be another lottery in 2014 H1-B petitions and what to do if the petition is not selected. Some clients raise the question: "Before lottery, the USCIS won't review the petition. So, can the employer submit multiple or duplicate filings to raise the winning rate?"


In a short answer, no.


On March 19, 2008, USCIS announced a regulatory change to prohibit employers from filing multiple or duplicate H-1B petitions for the same employee. That includes the same employer petitions for the same employee for the same job title and also includes the same employer petitions for the same employee for different titles. If multiple or duplicate petitions are found, USCIS will deny or revoke the petitions and will not refund the filing fees submitted.
