Employment-Based Immigration: Third Preference EB-3

You may be eligible for this immigrant visa preference category if you are a skilled worker, professional, or other worker.

• “Skilled workers” are persons whose job requires a minimum of 2 years training or work experience, not of a temporary or seasonal nature
• “Professionals” are persons whose job requires at least a U.S. baccalaureate degree or a foreign equivalent and are a member of the professions
• The “other workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.

綠卡申請第三優先類別(EB-3)：“技術及非技術工人”綠卡

以下三類人士可申請EB-3類綠卡

1. 有高等學位的專業人員：泛指那些從事需要經過高等專業教育或具備同等專業知識水平方能從事之專業性工作的人。
2. 技術工人：所從事的工作不是專業性工作、也無需取得學位即能從事之工作。但該工作至少需要2年的培訓或工作經驗方能從事。
3. 非技術工人：從事不需要培訓或培訓時間2年以下之工作的人，當然，具體的工作也許需某種特定的培訓或經驗，但如不超過2年應屬於這一小類。

因為非技術工的工資和工作環境比專業人士、技術工人都要低，國內解決不了招工難題，目前美國此類勞工缺口最大，加上對申請者的語言、學歷、外語、工作經驗沒有要求，主要以美國雇主的資格獲得移民簽證，所以簽證通過率很高。

非技術工人移民申請須勞工紙申請程序，勞工紙獲批後才能提交移民申請，由於此類移民每年有一定的配額限制，受益人須等到排期到了方可到美國領事館簽證或在美國境內調整身份。

EB-3受益人的配偶及未滿21周歲的未婚子女可以同受益人一起遞交I485申請，與受益人同時獲得美國綠卡。
