EB1-B: EMPLOYMENT-BASED IMMIGRATION FIRST PREFERENCE CATEGORY B - OUTSTANDING PROFESSORS AND RESEAR

EB1-B is for outstanding professors and researchers. The applicant’s achievement must be outstanding and recognized internationally in a particular field. Petitioners must be prospective U.S. employers and beneficiaries must be outstanding professors and researchers.

Application Requirements

To apply EB1-B, beneficiaries must have at least three years of experiences in teaching or research and been recognized internationally. Beneficiaries must be entering the U.S. to pursue tenure, tenure track teaching, or a comparable research position at a university or other institution of higher education.

Eligibility Criteria

The beneficiary must have a job offer from prospective employer and meet at least two of the following USCIS criteria:

1. Recipients of major prizes or awards for outstanding achievement;
2. Members in associations that require their members to demonstrate outstanding achievement;
3. Have published material in professional publications written by others about the alien's work in the academic field;
4. Have participation, either on a panel or individually, as a judge of the work of others in the same or allied academic field;
5. Have original scientific or scholarly research contributions in the field;
6. Have authorship of scholarly books or articles (in scholarly journals with international circulation) in the field. 

傑出教授或研究人員 (Outstanding Researcher or Outstanding Professor. EB1-B)

EB-1B針對在某一特定的科學或學術領域中，取得國家級或國際性聲譽的教授或研究人員。雖然EB-1B不需要申請勞工紙，但是受益人的工作必須是永久性工作，需要由美國雇主作為申請人為受益人提出申請。受益人必須在某學術領域中至少執教或從事研究工作三年以上。攻讀博士學位期間的研究工作可以算作申請EB-1B中的工作經驗。移民法§8 CFR 204.5(i)(3)(i)提出瞭如下6條具體的衡量標準, 受益人需符合其中的至少2條：

1. 因傑出成就而獲得重大獎項或名譽；
2. 擁有隻有傑出成就的人士才能加入的協會組織的會員資格；
3. 在專業出版物上，有報導該外籍人士的成就的文章（並不僅僅是引用外籍人士的作品或成果）；
4. 參與評審過他人作品，或擔任過著名期刊的評委；
5. 在國際發行的期刊上發表過文章，或著有過學術書籍；
6. 在所在的專業領域，作出有原創性的科學、學術或藝術貢獻。

EB-1B受益人的配偶及未滿21周歲的未婚子女可以同受益人一起遞交I-485申請，與受益人同時獲得美國綠卡。
