綜合撥款法案2016(Public Law114-113)被奧巴馬總統於2015年12月18日簽署成為新法,增加的費用是針對某些H-1B和L-1的申請者。這些申請者需要付額外的申請費用,也就是說H1-B的額外費用就會變成$4,000,而L1的就是$4,500, 這項法律在2015年12月18日起開始生效。

這項新法還提到其他H-1B和L-1的申請費用包括基本費用,欺詐預防,檢測費,和1998年(ACWIA)的申請費用還是需要支付的。需注意的是,在申請過程中,那些付費不夠的申請人將會被拒絕跟退件;而以上所列的所有費用需要是分開的支票。另外需要注意的是這項額外收費僅限於僱用50名或以上員工的公司, 還有H-1B或L類員工的非移民身份的員工占公司總員工人數50%以上的申請者(包括L- 1A和L-1B)。這項法律將持續至2025年9月30日。

Public Law's Fee Update

The Consolidated Appropriations Act, 2016 (Public Law 114-113), signed into law by President Obama on December 18, 2015, increases fees for certain H-1B and L-1 petitioners. These petitioners must submit an additional fee of $4,000 for certain H-1B petitions and $4,500 for certain L-1A and L-1B petitions postmarked on or after December 18, 2015.

The notice states that all other H-1B and L-1 fees including the Base fee, Fraud Prevention and Detection Fee, and American Competitiveness and Workforce Improvement Act of 1998 (ACWIA) Fee when applicable, are still required. Petitions with incorrect fees may be rejected. Petitioners are reminded that USCIS prefers separate checks for each filing fee.This additional fees apply to petitioners who employ 50 or more employees in the United States, with more than 50 percent of those employees in H-1B or L (including L-1A and L-1B) non-immigrant status. These petitioners must submit the additional fees with an H-1B or L-1 petition filed:

  • Initially to grant status to a non-immigrant described in subparagraph (H)(i)(b) or (L) of section 101(a)(15) of the Immigration and Nationality Act; or
  • Public Law 114-113 fees will remain effective through September 30, 2025.
